Private or Business Seller? How Marketplaces Decide

The account rules that change your fees, buyer rights and risk of a ban.

By reva editorial teamUpdated 9 min read
Two seller accounts side by side, private and business, with the fee, return and listing-limit rules that change between them
Key takeaways
  • None of the official Vinted, OLX, Allegro or eBay pages read for this article gives a sales count or revenue figure that makes you a business. Vinted lists signals, such as order count, revenue and the same item in several sizes, and can hide listings or ban the account.
  • Vinted Pro was listed in 8 countries on 13 Sept 2026 (Italy, Netherlands, France, Spain, Portugal, Luxembourg, Belgium, UK), not Poland or Germany. In the UK, Pro buyers can return an item for any reason within 14 days, even washed or used.
  • On OLX, publishing with the "firmowe" parameter or holding Business User status puts you on business limits in every category, and the business free-listing limit is 0 in many categories, so every business listing there is paid.
  • Allegro Lokalnie accepts listings only from regular accounts. A business account can buy there but not sell.
  • eBay.co.uk charges UK-based private sellers no final value fee, while business sellers pay, for example, 11.9% plus a per-order fee in clothes. Listings that sell after you switch pay business fees.

The private vs business seller line is set by why you sell, not by a published number. Marketplaces treat you as a private seller when you sell your own things, and as a business when you sell for a commercial purpose, such as buying stock to resell. None of the official Vinted, OLX, Allegro or eBay pages read for this article gives a sales count or revenue figure that marks the line, yet crossing it changes your fees, lets buyers return items for any reason and can get listings removed.

Below: how each marketplace draws the line, what the business side costs in fees and returns, and the order to switch in. Platform facts were read on official pages on 13 September 2026; worked examples are marked.

Private vs business seller: what changes

  • Fees. A UK-based private seller on eBay.co.uk pays no final value fee; a business seller pays a percentage of every sale. On OLX, the business free-listing limit is 0 in many categories.
  • Returns. Business sales to consumers carry a withdrawal right.
  • Enforcement. Vinted can hide listings or ban an account that sells commercially on a personal account.

Vinted bans individual users from listing items "intended to be sold for commercial purposes", and Poland's biznes.gov.pl describes business activity as organised, continuous, profit-oriented activity in your own name. If you buy items in order to sell them, check each platform's business rules before your next listing, not after a warning.

Vinted: personal accounts and commercial signals

Vinted's "Our platform" page (UK) says you must "create a personal account for your own benefit and not for any professional reasons". Its "Commercial selling" help article warns that commercial listings may be hidden or removed and the account banned. The Catalogue Rules mention a suspension "e.g. for a period of 7 days", or a permanent block.

The UK and Polish help articles give the same list of signals and call it non-exhaustive:

  • Number of completed orders and revenue
  • Many new items, or items with tags
  • Identical or similar items in several colours or sizes
  • Stock or professional-looking photos
  • Low-value goods bought in bulk or dropshipped
  • Duplicate handmade listings, or services such as renting

No threshold is published, so volume alone won't clear you. A seller with few orders and a wardrobe of tagged stock in several sizes ticks more boxes than one clearing years of their own clothes. If most of what you list is stock you bought to sell, a standard account breaks Vinted's rules however few orders you have.

Vinted's updated Terms take effect on 5 October 2026 in Germany and France and on 8 October 2026 in the UK, the US and Poland. Value Added Resource reports that the UK update leaves Pro unchanged and renames the Buyer Protection fee the "Vinted fee". Re-read the commercial-selling rules after 8 October.

Vinted Pro: where it exists and what changes

On 13 September 2026, Vinted's Pro country list, shown identically on its UK, German, French and Polish help pages, named Italy, the Netherlands, France, Spain, Portugal, Luxembourg, Belgium and the UK. Poland and Germany aren't on it. A third-party guide adds Germany, Austria and Ireland, but the German help page doesn't, so treat that claim as unconfirmed. Is Vinted Pro available in Poland? covers the Polish answer.

In the UK, Vinted calls Pro "a legal requirement under the UK Consumer Contracts… Regulations 2013" for traders. Sole traders, charities and companies apply with a registration number and identity checks. Selling stays commission-free, but four things change on Vinted UK:

  • Buyers can return for any reason within 14 days, "including if it has been washed or used".
  • Buyer Protection Pro covers loss and damage only; you are liable for not-as-described items.
  • Orders complete automatically after 14 days unless the buyer raises an issue, versus a 2-day claim window for private orders.
  • Bundles are allowed, but "bundle discounts cannot be applied".

If you trade from Poland or Germany, Pro isn't offered. Vinted's terms make standard accounts personal-only, and none of the Vinted pages read describes another route for traders there.

OLX: the "firmowe" parameter and business limits

OLX's Terms define a Business User as someone running a business or professional activity who uses OLX in connection with it. Under Annex 3, publishing with the "firmowe" (business) parameter, or holding Business User status, puts you on business limits in every category, not just the one you listed in. Business Users must also give identification data before publishing or using OLX shipping.

Category (Annex 3, from 7 Jan 2026) Private Business
Smartphones, laptops, consoles, TVs 2 0
Team and individual sports 50 0
Moda (fashion) "-" (not explained) 50

A limit of 0 means every business listing is paid. The documents read don't give package or listing prices; OLX shows them in the app. Before you tick "firmowe", open the paid-listing price in your main category and deduct it from your maximum buy price for each item.

Allegro and Allegro Lokalnie: who may sell where

Allegro's account comparison says regular accounts are for private individuals and business accounts for entrepreneurs and registered entities. Adding company details to a regular account doesn't make it a business account, and a business account can't be shared, even with a spouse. Sole traders can convert a regular account.

Allegro Lokalnie accepts listings only from regular accounts: a business account can buy there but not sell. The account comparison doesn't mention selling limits for regular accounts on allegro.pl, so don't plan around limits quoted on unofficial sites.

If most of your sales happen on Lokalnie, converting closes that channel; compare Allegro vs Allegro Lokalnie first. Whether you must register a business at all is a separate tax question, covered as general information in reselling in Poland without registering a business.

eBay: private vs business fees in the UK, Germany and Poland

UK. UK-based private sellers pay no final value or regulatory operating fee outside Motors, with 300 free listings a month and 35p after. Their buyers pay a Buyer Protection fee instead. Business fees (page updated 4 August 2026) are charged on the total sale including postage, exclude VAT, include no free listings without a Shop, and apply to existing listings that sell after you switch.

Full tables: eBay UK fees for private and business sellers.

Germany. Since 1 March 2023, eBay.de has been free within Germany for private sellers resident in the EEA, Poland included: 320 free listings, then €0.50, and 5% if delivery is abroad. Business clothing pays 12% up to €990 plus €0.35 per order (€0.45 over €10). Details are in eBay Germany fees.

Poland. eBay.pl private sellers pay 11% up to 9,990 zł plus 0.25 zł or 1.35 zł per order. The regulatory fee is 0.43% on the help page but 0.35% plus VAT in Strefa Sprzedawcy; business fees weren't verified.

On eBay.co.uk and eBay.de, the private fee on a domestic sale is zero, so every business fee comes straight off your margin. Run the example above with your own typical sale price before you switch.

Buyer rights you take on as a business (14-day returns)

Private sellers owe less. Vinted UK private sales carry no change-of-mind return, and OLX's Terms say consumer-protection rules don't apply between consumers. On eBay UK and eBay.de, not-as-described protection still applies to private sellers, even if they don't accept returns.

Business sellers:

  • Poland: biznes.gov.pl lists the 14-day withdrawal right for distance sales even for unregistered activity. Allegro quotes the refund deadline as at most 14 days after withdrawal.
  • Allegro business accounts: the refund goes out automatically 7 calendar days after you pick up the return parcel, unless you refund or refuse it in the Zwroty tab first.
  • Vinted Pro, UK: 14 days, any reason, washed or used.
  • eBay business sellers: return rules weren't in the pages read.

If an item loses value once worn, price it as if some orders will come back used. Do private sellers have to accept returns? covers claims and refunds in detail.

How to switch without losing listings

eBay.co.uk says existing listings that sell after you switch pay business fees. The Vinted, OLX and Allegro pages read don't say what happens to live listings, so work in this order:

  • Vinted (Pro countries): finish open orders and withdraw your balance; conversion is blocked while orders are ongoing
  • Vinted UK: to keep a personal account as well, register it with a separate email and phone number
  • Record every live listing, its price and photos before converting
  • Allegro: sell or end Lokalnie listings, which a business account can't publish
  • eBay.co.uk: reprice live listings for business fees before you switch
  • OLX: check paid-listing prices in your categories before publishing with "firmowe"
  • Ask a tax adviser whether you need to register a business in your country

Account status is one of the bottlenecks in scaling a reselling business; the full route from first sale to business is in how to start reselling in Europe.

Frequently asked questions

How does Vinted detect commercial sellers?
Vinted publishes signals, not a threshold. Its commercial selling help article, identical on the UK and Polish sites, names order count and revenue, lots of new or tagged stock, the same item in several sizes or colours, stock photos and bulk-bought or dropshipped goods. The terms add that Vinted may use automated software to detect breaches. Since no number is given, judge your account by why you bought the items, not by how many you sold.
Do business sellers on eBay UK pay more?
Per sale, yes. UK-based private sellers pay no final value fee or regulatory operating fee outside Motors. Business sellers pay a percentage of the total sale, for example 11.9% in Clothes, Shoes & Accessories, plus £0.30 or £0.40 per order and a 0.35% regulatory operating fee, all quoted excluding VAT. In exchange, their buyers pay no Buyer Protection fee, which eBay charges only on purchases from UK-based private sellers.
Do I have to accept returns as a business seller?
When you sell to consumers at a distance, generally yes. In Poland, biznes.gov.pl lists the 14-day withdrawal right for distance sales even for unregistered activity. Allegro adds that the refund is due within 14 days of withdrawal, but you may hold it until the item or proof of sending arrives, and its automatic refunds for business accounts cannot be turned off or extended. On Vinted UK, Pro buyers get 14 days to return for any reason. General information, not legal advice.
